TL;DR
WAVOA is a forecasting tool for windsurfing, kitesurfing, and wave riding — not a safety device. Use your own judgement on the water. Don't abuse our servers, don't redistribute our forecasts commercially, don't try to break the app. We can suspend abusive accounts. You can cancel anytime. We're a small French company doing our best.
Accepting these terms
By creating a WAVOA account or using the app, you agree to these terms. If you don't agree, don't use the app — but we'll be sad about it.
Your account
- You must be at least 13 years old (or 16 in the EU). Under-16s in the EU need parental consent — see children's privacy.
- One human, one account. Sharing accounts breaks Plane and Foil billing.
- You're responsible for what happens under your account. Keep your sign-in safe.
Acceptable use
Don't:
- Scrape our forecast API. We pay real money for the model data and rate limits exist for a reason.
- Resell, sublicense, or rebrand WAVOA forecasts. Plane is for personal use.
- Reverse-engineer, decompile, or extract our code beyond what's allowed by EU law (Directive 2009/24/EC, Article 6).
- Submit illegal, harassing, or abusive content via custom spot names, session notes, or our support inbox.
- Use WAVOA to train a competing forecasting model.
Do:
- Use the app to plan windsurfing, kitesurfing, wave/SUP/longboard surfing, sailing, paragliding, fishing, or anything else outdoors. We're not picky — though it's tuned for the first three.
- Tell your friends. Word of mouth is our only marketing.
- Tell us when something is broken — contact form.
Subscriptions, billing & refunds
- Plane and Foil are billed monthly or annually through the App Store, Google Play, or Stripe.
- Subscriptions auto-renew until you cancel. Cancel anytime in your store account or via Profile → Subscription.
- Refunds. Within 14 days of first purchase, no questions asked, EU consumer law style. After that, store policy applies — Apple and Google handle their own refunds.
- Annual plans cancelled mid-term keep working until the end of the period. We don't pro-rate refunds beyond the 14-day window unless required by law.
Our intellectual property
The WAVOA name, logo, app, website design, code, copy, and meteogram visualisations are ours (or our licensors'). Forecast model data is licensed from ECMWF, NOAA, DWD, and Météo-France under their respective terms. You don't get any rights to that beyond using the app.
Your content
Your logbook entries, custom spots, and notes are yours. We claim no ownership. By using sync, you grant us a narrow, free licence to store and transmit your content for the sole purpose of operating sync — nothing else. We don't read it, mine it, or train models on it.
Forecasts & safety
Forecasts are forecasts. Even the best models are wrong sometimes. WAVOA is a planning aid, not a substitute for your eyes, your local knowledge, your buddy, or formal weather services for marine safety. Always check official sources (e.g. NWS, Met Office, Météo-France marine bulletins) before going on the water in serious conditions.
WAVOA is not a safety-critical device. Don't use it for aviation, commercial maritime navigation, search and rescue, or anything where lives depend on a number being right.
Warranty disclaimer
The app is provided “as is” and “as available”, to the maximum extent permitted by law. We make no warranties about uptime, accuracy of forecasts, fitness for a particular purpose, or that the app will be bug-free. Your statutory consumer rights under EU and national law are not affected by this clause.
Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim arising from your use of WAVOA is capped at the greater of (a) what you paid us in the 12 months before the claim, or (b) €50. We are not liable for indirect, incidental, or consequential damages — including missed sessions, broken gear, or that one perfect day you didn't go because we said it would be 12 knots and it was 28.
Nothing in these terms limits liability for fraud, gross negligence, death or personal injury caused by our negligence, or any liability that cannot be limited under applicable law.
Termination
You can stop using WAVOA whenever. We can suspend or terminate accounts that abuse the service, scrape our API, or violate these terms — usually with a warning, always with a reason emailed to you.
Governing law
These terms are governed by French law. Disputes will be heard by the courts of Bordeaux, France — except that EU consumers can also bring claims in the courts of their country of residence, as required by EU consumer law. EU consumers can also use the European Commission's ODR platform.
Changes to these terms
If we change these terms in a material way, we'll email you 30 days before they take effect. Cosmetic edits — typo fixes, clarifications — happen silently and the version stamp at the top bumps.
